Obama blocks Chinese purchase of US wind farms

WASHINGTON (AP) ? Citing national security risks, President Barack Obama on Friday blocked a Chinese company from owning four wind farm projects in northern Oregon near a Navy base where the U.S. military flies unmanned drones and electronic-warfare planes on training missions.

It was the first time in 22 years that a U.S. president has blocked such a foreign business deal.

Obama's decision was likely to be another irritant in the increasingly tense economic relationship between the U.S. and China. It also comes against an election-year backdrop of intense criticism from Republican presidential challenger Mitt Romney, who accuses Obama of not being tough enough with China.

In his decision, Obama ordered Ralls Corp., a company owned by Chinese nationals, to divest its interest in the wind farms it purchased earlier this year near the Naval Weapons Systems Training Facility in Boardman, Ore.

The case reached the president's desk after the Committee on Foreign Investments in the United States, known as CFIUS, determined there was no way to address the national security risks posed by the Chinese company's purchases. Only the president has final authority to prohibit a transaction.

The administration would not say what risks the wind farm purchases presented. The Treasury Department said CFIUS made its recommendation to Obama after receiving an analysis of the potential threats from the Office of the Director of National Intelligence.

The military has acknowledged that it used the Oregon Naval facility to test unmanned drones and the EA-18G "Growler." The electronic warfare aircraft accompanies U.S. fighter bombers on missions and protectively jams enemy radar, destroying them with missiles along the way.

At the Oregon site, the planes fly as low as 200 feet and nearly 300 miles per hour.

The last time a president used the law to block a transaction was 1990, when President George H.W. Bush voided the sale of Mamco Manufacturing to a Chinese agency.

In 2006, President George W. Bush approved a CFIUS case involving the merger of Alcatel and Lucent Technologies.

The Treasury Department said in a statement that Obama's decision is specific to this transaction and does not set a precedent for other foreign direct investment in the U.S. by China or any other country.

China's trade advantage over the U.S. has emerged as a key issue in the final weeks of the presidential campaign. Romney accuses Obama of failing to stand up to Beijing, while the president criticizes the GOP nominee for investing part of his personal fortune in China and outsourcing jobs there while he ran the private equity firm Bain Capital.

Both campaigns are running ads on China in battleground states, especially Ohio, where workers in the manufacturing industry have been hard-hit by outsourcing.

Obama, in an interview Wednesday with The Plain Dealer of Cleveland, said the U.S. must push hard against Beijing but "not go out of our way to embarrass" China.

"We're not interested in triggering an all-out trade war that would damage both economies," Obama said.

The president has the power to void foreign transactions under the Defense Production Act. It authorizes the president to suspend or prohibit certain acquisitions of U.S. businesses if there is credible evidence that the foreign purchaser might take action that threatens to impair national security.

CFIUS is chaired by the treasury secretary. The secretaries of state, defense, commerce, energy and homeland security are also on the committee. The director of national intelligence is a non-voting member.

Earlier this month, Ralls sued the national security panel, alleging CFIUS exceeded its authority when it ordered the company to cease operations and withdraw from the wind-farm developments it bought. Ralls asked for a restraining order and a preliminary injunction to allow construction at the wind farms to continue. The firm said it would lose the chance for a $25 million investment tax if the farms were not operable by Dec. 31.

But Ralls dropped the lawsuit this week after CFIUS allowed the firm to resume some pre-construction work.

Ralls' legal team includes Paul Clement and Viet Dinh, two top law veterans of President George W. Bush's administration. Both men were key players in Bush's aggressive national security operation.

Clement, who was solicitor-general and argued administration positions before the Supreme Court, has since opposed the Obama administration's health care plan and defended the Defense of Marriage Act before the top court.

Dinh, a former assistant attorney general who was the main architect of the Bush administration's anti-terror USA Patriot Act, has lately served as a director and legal adviser to Rupert Murdoch's News Corporation.

A second Chinese firm stymied by CFIUS urged U.S. authorizes this week to investigate their firm to quell fears of ties to China's military. Huawei Technologies Ltd. announced in early September that it would unwind its purchase of U.S.-based computer firm 3Leaf Systems after the deal was rejected by CFIUS.

Huawei, one of the world's largest producers of computer network switching gear, has repeatedly struggled to convince U.S. authorities that they can be trusted to oversee sensitive technology sometimes used in national security work.

It's no secret that October is Breast Cancer Awareness month, and the Lynn Sage Foundation is one of the most prominent Breast Cancer foundations around. Five years ago, the foundation implemented a program called In Good Taste to raise even more money for the cause. The group partners with more than 100 restaurants in and around the city, and when you dine, $1 per check or more (if you're feeling generous) goes directly to the Lynn Sage Scholars Program at Northwestern University. And the participating restaurants? Well, they run the gamut from the the laid-back and casual (Wow Bao, Adobo Grill) to the chic and upscale (Four Seasons Hotel, Ritz Carlton), so there's something for everyone.

Other restos are getting in on the giving back action, too, in their own ways. Places like Bar Umbriago and the LM restaurant group will offer special "pink" drinks such as a Pink Martini or Kir Royale. And portions of the proceeds will go to the Lynn Sage Foundation, or Susan G. Komen Foundation.

But drinks aren't the only thing on the menu. Places like Chicago Cut, Porkchop and Kanela Breakfast Club will offer specially priced dishes, in which a portion of the proceeds go to a cancer foundation. We love it when food and philanthropy merge.

What?s with all the inspired people? Organizers, advisers, partners and other supporters of TEDxAmsterdam gathered at the Mayor?s home for the unveiling of this year?s line-up of all-star speakers. The evening began with a gathering in a grand and elegant room by deputy mayor Caroline Gehrels, embellished with intricate gold and red d?cor, topped off with a spectacular chandelier in the middle. Guests excitedly conversed and greeted new friends.

The first guests I had the pleasure of meeting were two women involved in the organization and advisory of TEDxAmsterdam and TEDxAmsterdamWomen. I made it a goal to understand why it is all these guests are passionate about TEDx, so I inquired and was not the least bit disappointed with their responses. Brain Trust member, Astrid Elburg, shared that she most looks forward to seeing speakers who ?bring a sparkle? and who are able to use the fire within and share it with the audience. She described the beauty of TEDx to bring people together from all over the world and to ?open peoples? minds?. Astrid also highlighted it as an innovative way for people to learn, whether they are being moved by them in the audience or watching online. Interestingly, I agreed when she emphasized the feeling aspect of TEDx events, and how they reach into peoples? core.

Another stand out Brain Trust guest amongst the many in the room was Peter van Lindonk. An innovator and social change-maker in his own right, Peter is so passionate about the power of events like TED that he was inspired to start his own PINC conference. After attending five TED events in the United States he was determined to bring this unique and profound experience to Europe. When asked what he looks forward to in the upcoming TEDxAmsterdam edition, he excitedly commented, ?I go for the bouquet, never for a flower!?. It was an eloquent reminder that any TEDx taken as a whole is much more powerful and moving. I was aware of the aura and key features of TEDx events at this partner meeting. An experience that appeals to all of one?s senses: sight, sound, emotion, mind and more!

Cherishing a love for life

It was a joy to discuss with people how TEDx has touched them each differently, and yet always significantly. Many cherish TEDx for enabling people to meet, raise awareness and share ideas. Many look forward to the audience?s reactions and the impact of the speaker. Through all my conversations with TEDxAmsterdam organizers and leaders there was one constant. You could always sense the passion that drives these individuals and has made them a committed and hardworking team. Performer Celine Cairo captured this phenomenon with her reference to being a ?TEDx junkie?. She followed by explaining that she is so passionate about TEDx because it has reminded her of her love for life, a notion I think most TED supporters can relate to.

I for one had a unique experience: without ever attending a TEDx conference first hand, I?ve already sensed a touch of TED by talking to these passionate TEDxAmsterdam fans.

How To Get Out Of A Dominating Handshake - Business Insider

In a business interaction, if you notice that your companion is trying to give you a handshake with their palm facing downwards, you should immediately strategize on how to get out of this.?

Why??

Because a?handshake is supposed to be a greeting gesture that symbolizes both parties are on equal grounds, yet allowing your palm to face upward while your companion's palm is facing downward is basically allowing them to have the upper-hand, meaning they are now in control and you are not.

This is a bad move during negotiations.

The vibe between the two of you have already been established with that first handshake and everything you say from this moment forward will always have the "lower-hand" to their "upper-hand," especially if they were trying to intimidate you with this handshake.?

"[It] is the most aggressive of all handshakes because it gives the receiver little chance of establishing an equal relationship," according to Westside Toastmasters, a non-profit organization aimed at helping people?improve their public speaking and leadership skills.

Toastmasters shared three techniques on getting out of these overbearing handshakes:

1. The Step-to-the-Right Technique.

Basically, if you're right-footed ("The natural position for 90 percent of people when shaking with the right hand), you'll have more of an advantage when you step into the handshake with your left foot, and vice versa.

When someone extends their hand for a dominant handshake, you can prevent this interaction from happening by first stepping forward with your left foot.

Next, step forward with your right leg and into the other person's personal space. You can then cross your left leg across your right leg (Although, we've tried this and it's a little awkward).?

"This tactic allows you to straighten the handshake or even turn it over into the submissive position. It feels as if you're walking across in front of him and is the equivalent of winning an arm-wrestling bout. It also allows you to take control by invading his personal space."

2.?The Hand-on-Top Technique.

As you're going in for the dominating handshake, respond with your palms up at first; then, place your other hand ? the left one ? over your companion's hand to form a "Double-Hander" and simply straighten the handshake to a more equal position.

This technique is easier for women to use.?

3. The Last Resort Technique.?

If all else fails, and you feel as though your companion is trying to intimidate you, grab their hand from the top and shake it. But only do this as a last resort since it can shock the other person and is a very obvious maneuver.?

Americans still addicted to overdraft - The Term Sheet: Fortune's - CNN

FORTUNE -- The financial crisis was supposed to spur a new era of frugality and fiscal responsibility. It doesn't exactly appear to be working out that way.

Americans are once again increasingly overspending what they have in their checking accounts. In all, consumers were hit with $31.5 billion in so-called overdraft fees by banks in the past year, according to a new study from bank research firm Moebs Services. That compares to $30.8 billion in the same period a year before.

That was below the peek of $36.8 billion in the same period in 2008. But this year is still the first time overdraft fees have risen since the financial crisis. From mid-2008 to mid-2011, the number of times consumers were hit by overdraft fees had fallen by roughly a third. Now in the past nine months, the levying of overdraft penalties appears to be on the rise again, up 10% in the past nine months.

The question is whether this a a result of shady bank practices or poor money management. On the margin, it appears that overdraft fees have gotten a little more fair. Banks have shelled out hundreds of millions to settle claims that they re-ordered consumer purchases in order to trigger overdraft penalties as often as possible. And the Card Act made it illegal for banks to automatically enroll customers in overdraft protection, limiting the number of people who get hit with fees they didn't even know about.

There's probably still more work to be done to make these fees fair. Earlier this year, the Consumer Financial Protection Bureau said it was looking into way banks impose overdraft fees. Clearly, the pricing of overdraft fees, which average $30 per penalty, by banks still seems unfair. A similar loan from a payday lender would run you $17, according to Moebs.

But the most unfair thing about these fees might not be how they are charged, but who gets charged. Earlier this week, Bankrate.com came out with a study that said ATM fees and high minimums basically means free checking accounts are dead.

Still, while more people, though still not nearly everyone, pay something for the use of their bank account, most of us don't pay very much. There are about 150 million bank accounts in America, which generate around $41 billion in fees for banks. About three quarters of that, though, comes from overdraft penalties. And, according to Michael Moebs, 90% of overdraft fees are generated by just 18 million customers. The result: As with many other financial products, the vast majority of the costs of banks accounts are hoisted off on a relatively small population, and generally it's a population that is the least able to pay.

During the height of the Occupy Wall Street movement last year, Bank of America announced that it was considering charging all of its debt card customers a $5 monthly fee. The Occupiers reacted with outrage and disbelief. They organized sit-ins at bank branches, and called for people across the country to close their accounts at big banks and move their money to community banks. Eventually, Bank of America relented, and that was seen as one of the few big wins for the Occupy Wall Street movement.

Bu in retrospect it's not clear it was. The Occupiers may have squashed a move that might have made the financial sector a heck of a lot more fair. Banks should be scrapping overdraft fees in favor of lower broad based fees that everyone has to pay. The Occupiers underscored how hard it will be hard for banks to do that.

Continuing Claims fell by 4k and Extended Benefits were lower by 2k. Bottom line, while one week doesn't make a trend, the pace of firings took somewhat of a break on the week. Todd Akin Gets Support; Claire McCaskill Attacks

The Missouri Senate race officially kicks into high gear with less than six weeks until the general election. GOP candidate Rep. Todd Akin began a four-day bus tour Tuesday that will criss-cross the state. Meanwhile, incumbent Sen. Claire McCaskill released a new push for advertising in Missouri. Despite calls for Akin to resign after controversial remarks Aug. 19, the deadline for him to drop out of the race passed by quietly at 5 p.m. Tuesday.

Where did Akin start his statewide tour?

The St. Louis Post-Dispatch reports Akin started in his home territory of St. Louis. Upon launching the Common Sense Bus Tour , Akin told the media outlet in front of 200 cheering supporters, "I have a purpose going into November and that's to replace Claire McCaskill."

Later in the day as the official deadline to drop out passed, Akin was in Cape Girardeau. The Southeast Missourian reveals the conservative candidate spoke for close to 30 minutes in the Bootheel where he reiterated, "And when all is said and done, the people of Missouri chose me to do a job -- and that is to replace Claire McCaskill."

What is McCaskill doing to counter Akin's tour?

A new 30-second advertisement was released called "Todd Akin In His Own Words ." The image of a one-a-day calendar shows Akin's attacks on Social Security in March 2011, Medicare in September 2011, the minimum wage in March, student loans in April and abortion rights with "legitimate rape" in August. The ad concludes, "What will he say next?"

McCaskill also unveiled a new fundraising campaign called "He's In, Let's Win. " The incumbent has a $600,000 fundraising goal between now and Sunday. McCaskill's campaign says, "It's only a matter of time before the Koch brothers and Karl Rove find a way back into Missouri. ? Republicans in Washington are coming back to Missouri... ."

How is Akin's fundraising going?

Reuters reports the Senate Conservatives Fund sent an email to around 100,000 members Tuesday asking if the PAC should send financial resources to the GOP Senate campaign in the Show-Me State. The Missouri Republican Party also voiced its support for Akin. Chairman David Cole told Reuters, "The Missouri Republican Party will do everything we can to assist in [Akin's] efforts."

What groups are backing the conservative candidate?

KOLR states Freedom's Defense Fund will spend around $250,000 buying television and radio advertising to counter McCaskill. Mark Centanni told KOLR the ad buy will be the largest investment in a single election anywhere in the country this fall. He also said one main reason the fund is backing Akin is due to the "establishment making [the comment] into a bigger deal that I think it otherwise would have been."

The New York Times interviewed families of homeschooled children who back Akin. John Thrower told the Times he supports Akin because the candidate homeschooled his own children, just like Thrower does. KTTS reports Sen. Roy Blunt admitted he will work for Akin's election even though the two politicians disagree on many issues.

UK regulator clears BSkyB of links to hacking scandal

LONDON (Reuters) - Britain's media regulator gave pay-TV firm BSkyB a clean bill of health on Thursday, saying there was no evidence it was linked to a phone hacking scandal which has engulfed Rupert Murdoch's News Corp, its largest shareholder.

The investigation by Ofcom, which has clashed repeatedly with BSkyB in the past, had hung over the hugely successful group and raised the prospect of News Corp being forced to sell down some of its near 40 percent holding.

"To date, there is no evidence that Sky was directly or indirectly involved in any of the wrongdoing either admitted or alleged to have taken place at News of the World or The Sun," Ofcom said, referring to News Corp newspapers.

It concluded BSkyB was "fit and proper" to hold a broadcasting license.

Prompted by the admission that journalists at Murdoch's now-defunct News of the World tabloid had hacked into phones on an industrial scale, Ofcom examined whether News Corp was an appropriate owner and whether James Murdoch, Rupert's son, was an appropriate director.

It found News Corp to have acted properly and said that although James Murdoch's conduct in relation to events at the News Corp newspapers had repeatedly fallen short of the standards expected of someone in his position, there was no evidence to suggest he had deliberately engaged in wrongdoing.

James Murdoch is a former chief executive and chairman of BSkyB who was in charge of News Corp's British newspaper arm when the scandal escalated last year. He stepped down as chairman of BSkyB in April in a bid to protect the company's reputation from being damaged.

The admission of wrongdoing at Murdoch's powerful British newspaper arm, including the detail that staff had hacked into the voicemails of a murdered schoolgirl, sent shockwaves through the political and media establishment last year.

Under pressure for his own close ties to Murdoch's media group, Prime Minister David Cameron ordered a judge-led inquiry to investigate the scandal while journalists at Murdoch's daily Sun tabloid are still being arrested over allegations of illegal payments to public officials.

The issue of whether the Murdochs were "fit and proper" to run a British media company has become a recurring theme, after a parliamentary committee said the scandal had shown Rupert Murdoch not to be fit to run a major international company.

More than 80 people have now been arrested in total over allegations of phone hacking, illegal payments, computer hacking and attempts to pervert the course of justice.

The sense of public outrage also forced News Corp to pull its $12 billion bid to buy the rest of BSkyB it did not already own.

"This was, on balance, expected but it definitely removes an overhang on the stock," Liberum analyst Ian Whittaker said of Ofcom's findings. "This wasn't seen as a huge threat to the business but ... this was seen as a risk, because Ofcom and Sky don't have a great relationship."

Shares in BSkyB were up 1 percent against a wider FTSE 100 Index which was down 0.7 percent.

"As a company, we are committed to high standards of governance and we take our regulatory obligations extremely seriously," BSkyB said.

Flight cancellations surge at American Airlines

Flight cancellations have spiked at American Airlines, which is fighting with unhappy pilots.

The Wall Street Journal's veteran travel reporter, Scott McCartney, on Tuesday told travelers to avoid the carrier because "American's operation is in shambles."

McCartney said American Airlines is too unreliable because of trouble with the pilots union.

Denny Kelly, an aviation expert and former pilot, said he agreed that travelers should avoid the Fort Worth-based airline.

"If you're going to fly a trip from Dallas to someplace and you have a choice, and you have to be there on time or within a reasonable amount of time ... why take a chance? on American?" he said. "Why take a chance on [if] a flight's going to be delayed or canceled? Go on somebody else that doesn't have that problem."

But that could be easier said than done when flying in or out of North Texas.

"The problem is, at DFW, 75 percent of the flights are American, so what do you do?" Kelly said.

American said on Monday that it would reduce the number of flights at least partly because of staffing shortages.

American spokesman Bruce Hicks said the airline was cutting its schedule for the rest of September and October by 1 to 2 percent because of "a number of factors." Among them is an increase in pilots calling in sick and maintenance reports filed by flight crews.

The airline has struggled over the past few days with a large number of pilots calling in sick and a higher-than-usual number of requests for aircraft maintenance.

An American Airlines representative told NBC 5 on Tuesday that it is aware of the higher sick levels and maintenance requests. The company said the airline is being proactive and is taking steps now to prevent more problems in the future.

American canceled more flights on Sunday and Monday than any other airline.

On Tuesday, only 53 percent of American's flights arrived on time.

"I would say it's about a D-minus," Kelly said.

Tuesday's on-time number was higher than Monday's 39 percent and Sunday's 48 percent.

Kelly said the situation is ultimately the fault of the airline's management because of how it has mistreated the pilots.

"The pilots are the ones that are involved in this job action, if you will," he said. "And, of course, it's not organized, they say. But that's exactly what it is. And the bottom line is, if a pilot follows every rule in the FARs ? the federal regulations ? the contract, the company regulations, they'll shut the airline down, and that's exactly what they're doing."

The cancellations came a few days after American imposed new cost-cutting terms on its pilots, including outsourcing more flying jobs to other airlines and terminating one of the pilots' retirement programs in November. Pilots rejected more-generous terms in the last contract offer from American, which has been under bankruptcy protection since November.

Last week, the union sent out ballots for a strike-authorization vote, although federal officials have not cleared the way for a legal strike at the nation's third-biggest airline.

O'Reilly, Stewart to debate on presidential race

Pick your pundit when Bill O'Reilly and Jon Stewart face off for a special 90-minute debate about the 2012 presidential race.

The host of Fox News Channel's "The O'Reilly Factor" and the anchor of Comedy Central's fake newscast "The Daily Show with Jon Stewart" have announced they will clash in the event, dubbed "The Rumble in the Air-Conditioned Auditorium."

This live debate will be streamed online on Oct. 6 from George Washington University in Washington, D.C. The price is $4.95, with one-half of the profits donated to a number of unspecified charities.

In a statement, Stewart quipped that "The Rumble" will be entertaining for all, including "people who just enjoy yelling."

Don't mess with the world's largest jellyfish

FLOATING like an exotic fruit in the icy waters of northern Russia's White Sea, this lion's mane jellyfish (Cyanea capillata) was photographed by Alexander Semenov, head of the dive team at the White Sea Biological Station, in what was only his second photo opportunity with the species in 10 years of diving. It was an unforgettable experience, he says, and "this time I was with a camera".

The lion's mane is the world's largest jellyfish and the White Sea's largest invertebrate. The bell of White Sea jellies can grow to 70 centimetres across and its translucent tentacles can be 15 metres long. "Even if you try to dodge, it still touches you," says Semenov.

The tentacles can give a painful sting, but are not known to be lethal. Despite wearing a full-length wetsuit and mask, Semenov was stung across the face. "It paralysed my lips," he says. "They were as big as Angelina Jolie's but not so beautiful. I couldn't talk for an hour, and it hurt for days. Now I try to be more careful."

Adult lion's mane jellyfish eat everything from fish fry and krill to other jellyfish, such as the moon jellyfish (Aurelia aurita). "They are fantastically voracious predators, but this is what allows them to grow so large," he says. He speaks of "floating stomachs" filled with five or six moon jellies at a time - some still alive and struggling.

The White Sea Biological Station is a remote outpost of Lomonosov Moscow State University. During the polar summer, its community of international researchers and visiting students enjoy a northern paradise, with midnight beach parties under a sun that never sets. In winter, those who remain cannot leave the station without skis because the snow reaches chest height. "And there's the silence," says Semenov. The only sound is the ice popping as the tide rises and falls.

What does a fighter look like? (PHOTOS)

I've often heard the phrase, "He/she doesn't look like a fighter!" This comes up especially before women's fights, when Ronda Rousey's cover girl looks are cited as a reason to be shocked that she can rip your arm off. I hear it about Georges St-Pierre, who could easily find another career on a runway. UFC president Dana White brought it up recently when he criticized Roy Nelson's mullet, beard and belly.

But the thing about MMA is that outside making weight the day before a fight and passing a ton of medical tests, there are no physical requirements to step in a cage. While fighters look like this:

Topless photos ruling: 1st battle in privacy war

LONDON (AP) ? Prince William and Kate Middleton's aggressive legal strategy over topless photos of Britain's likely future queen is the first salvo in what could be a decades-long tug-of-war over their family's privacy.

A French court ruled in favor of the royal couple on Tuesday in their fight over the photos, but the scope of that ruling will be limited.

The unauthorized topless photos of Kate have already been widely published in France, Italy, Ireland and on the Internet ? lessening the impact of Tuesday's court injunction against future publication inside France.

The royals' strong stance also included a bid to persuade French prosecutors to launch a criminal inquiry to target the offending photographer.

The wealthy royal couple did not gain much on paper ? the court-imposed fine was about $2,500 ? but legal experts and royal watchers say the action was designed to demonstrate their willingness to use all legal means to prevent future press intrusion.

That will become even more important when the couple have a child, who would become third in the line of succession to the British throne, said Joe Little, the managing editor of Majesty magazine.

"This was done because they want to set a benchmark for the future," he said.

"They want to send a warning to anybody who might think of doing something similar in the future."

The fast legal intervention, which developed within hours of the publication of the photos Friday in a French gossip magazine, represents a break from Queen Elizabeth II's traditional policy of using legal action only as a means of last resort. It also reflects William's determination not to let the press harass Kate as it did his late mother, Princess Diana, Little said.

Still, the case shows the unlikelihood of controlling photos through legal means once they have been published.

Closer magazine was ordered to turn over all of its digital copies of the photos, but that has little meaning in a world where millions of copies can be made and distributed in the blink of an eye.

The revealing pictures will follow Middleton for the rest of her life ? not unlike the snapshots of her appearance in a charity fashion show wearing black lingerie and a sheer dress during her university days.

"Clearly, the harm has been done," said Christopher Mesnooh, an American lawyer working in France for Field Fisher Waterhouse. "Thousands, now tens of thousands of copies, are now in public circulation. A legal decision is a wonderful thing to obtain and the royal couple did exactly what they should have done. But you know the magazine is out there and I suspect most of you have already seen copies of that magazine, so the basic, the initial harm, has been done."

He said magazine executives had concluded in advance they had little to fear from an adverse court ruling when they decided to print the photographs, obtained by a photographer who trained a long lens on the royal couple as they sunbathed on a private estate in southern France.

"Closer magazine has done a very sophisticated cost-benefit analysis," Mesnooh said. "Whatever the amount of damages that a French court will award, it will be a fraction of the publicity that the magazine will have gained, as well as the number of issues of this particular issue of Closer magazine which will be sold."

Tuesday's ruling only affects the French magazine branch of Mondadori, Closer's publisher. A French court ordered it to hand over all digital copies of topless photos of the Duchess of Cambridge within 24 hours and blocked further publication of what it called a "brutal display" of William and Kate's private moments.

The court also stopped the magazine from republishing the pictures ? including on its website and its tablet app ? as well as re-selling them.

Mondadori faces a daily fine of ?10,000 ($13,100) if it fails to do so.

"These snapshots which showed the intimacy of a couple, partially naked on the terrace of a private home, surrounded by a park several hundred meters from a public road, and being able to legitimately assume that they are protected from passers-by, are by nature particularly intrusive," the French ruling decreed. "(They) were thus subjected to this brutal display the moment the cover appeared."

The photos showed Kate relaxing at a private villa in Provence, in southern France, sometimes without her bikini top and, in one case, her bikini bottom partially pulled down to apply sunscreen.

The royal couple is also filing a criminal complaint against 'X' ? the unnamed photographer who took the picture.

The suit aims to flush out the mystery photographer's identity and prevent him or her from spreading the photos to new locations. If the case goes forward, the photographer could face a substantial fine and a one-year prison term.

But fines and prison terms won't remove the photos from the Internet.

Professor Tim Luckhurst, head of the journalism department at the University of Kent, said the royal couple has likely learned some lessons from the debacle.

"The prince and his wife are going to have to think hard about what sort of conduct is acceptable for the heir to the throne and his wife in the age of the Internet," he said.

Arrest on suspicion of Malibu DUI for actor Madsen

MALIBU, Calif. (AP) ? Michael Madsen was arrested Wednesday on suspicion of drunken driving on the Pacific Coast Highway in Malibu, and was expected to spend the night in a hospital, authorities said.

It was the second arrest in six months for the "Reservoir Dogs" actor.

Madsen was pulled over for driving erratically in a red Pontiac GTO shortly before 3 p.m. Los Angeles County Sheriff's spokesman Steve Whitmore said.

In a preliminary test Madsen had a blood alcohol level of .21, more than twice the legal limit of .08, Whitmore said.

While he was being booked, Madsen complained of a medical problem and was taken to a hospital, where doctors said he should spend the night. Deputies then cited and released him.

Whitmore said privacy laws prevent him from describing the medical problem.

A late-night phone message left for Madsen's attorney Perry Wander was not immediately returned.

Madsen is best known for playing killers in the Quentin Tarantino films "Reservoir Dogs" and "Kill Bill" parts 1 and 2, and also appeared in the family-friendly whale pic "Free Willy."

In March, Madsen was arrested at his Malibu home after what detectives said was a drunken fight with his teenage son, but prosecutors declined to file charges because of a lack of evidence.

RLI Corp. is now offering a reduced liability attachment point for its personal umbrella policy for Florida residents. Personal umbrella coverage is now available to customers whose primary residence is in Florida and who have a minimum homeowners liability limit of $100,000. This extended coverage is being offered because of recent changes in the personal liability insurance market in Florida. It is not available in other states.

For a flat fee, policyholders whose primary residence is in Florida may be eligible for the RLI personal umbrella policy even if they are unable to secure the standard $300,000 on their basic liability policy. This change is effective immediately for new applicants and will take effect November 1, 2012 for current policyholders (renewals). This new offering is also available through endorsement on current policies as of September 1, 2012. All other RLI personal umbrella policy provisions will remain the same.

RLI offers its personal umbrella product through a network of brokers, FAIA/IIABA relationships and partnerships with other insurance companies.

    Virgin Births Seen in Wild Vipers

    It usually takes two snakes ? a female and a male ? to make a litter of baby copperheads. But research now shows that copperheads (Agkistrodon contortrix) and their venomous cousins cottonmouths (Agkistrodon piscivorus) don?t always require a partner to establish the next generation. These vipers are capable of virgin births.

    For some vertebrates, parthenogenesis ? asexual reproduction in which embryos develop without fertilization ? is the norm. The New Mexico whiptail lizard (Cnemidophorus neomexicanus), for example, is an all-female species that reproduces without any genetic contribution from a male.

    But in zoos and aquariums, zoologists have begun to document the strange phenomenon of facultative parthenogenesis: females of species that usually reproduce sexually, delivering offspring without mating. Surprise pregnancies have been documented among birds, sharks, snakes and Komodo dragons (Varanus komodoensis), but until now, only in captivity.

    Warren Booth, a molecular ecologist at the University of Tulsa in Oklahoma, now reports the first known case of wild facultative parthenogenesis, publishing the study today in Biology Letters.

    In work conducted while he was at North Carolina State University in Raleigh, Booth and his colleagues captured pregnant wild copperheads and cottonmouths, which gave birth in the lab. The researchers suspected that some of the snakes had reproduced without male input: in comparison with those born from sexual unions, says Booth, asexually reproduced snake litters typically have a large number of failures in development such as stillborn babies, and few viable males. When he saw that some of the snakes had delivered broods with these characteristics, ?these litters were at the top of my agenda to genotype?, says Booth.

    Booth examined genetic markers in the mothers and offspring to check whether the young snakes had really been born as a result of facultative parthenogenesis, or were unusual broods sired by males that were genetically similar to the mother.

    ?When I got the results of the DNA sequencer, I was floored,? he says. The genotyping compared the genetic make-up of the offspring with the populations from which the snakes were collected; the results indicated that the chance of a male contribution was ?infinitesimally small?. Researchers had always believed that facultative parthenogenesis took place in the wild, Booth notes, but he and his colleagues were ?stunned? at finally finding the evidence.

    It is not clear how asexual reproduction evolved in normally sexual species, but the absence of a process called genomic imprinting may have had a role. In mammals, genomic imprinting causes a set of genes from one parent to dominate over the other, and this interaction requires genes from both parents to create viable offspring. Reptiles don't undergo genomic imprinting, so mating isn't required for mothers to develop their young ? but it is not known why.

    Nor is it known what spurred the female snakes to reproduce asexually. Booth points out that isolation from males is not the key: the snakes were collected from habitats with males, which undoubtedly were on the lookout for females. For whatever reason, the females forsook their potential mates, or rejected sperm from pairings, to deliver parthenogenic litters. Booth says that the finding removes the ?prevailing dogma? that facultative parthenogenesis occurs only when females are isolated.

    Phill Watts, an ecological geneticist at the University of Liverpool, UK, agrees that the study calculated ?a convincingly low probability for male parentage?. The discovery may motivate other researchers to search for further examples. ?We still lack data to understand when and why facultative parthenogenesis happens in the wild,? says Watts. There are almost certainly other asexually reproducing snakes, sharks and lizards out there, but the biological impetus for their wonderful births is, as yet, a mystery.
